Abstract
En los últimos años se ha experimentado un crecimiento en el flujo migratorio en España, y en el mundo en general. En muchos casos estas personas no conocen la lengua del país de llegada, por lo que necesitan asistencia lingüística y cultural para poder acceder a los servicios ofrecidos por la Administración Pública, así como para poder conocer y ejercer adecuadamente sus derechos y deberes. En este contexto de multiculturalidad y ante esta necesidad de asistencia lingüística y cultural surge la figura del traductor e intérprete en los servicios públicos (SSPP). Sin embargo, a pesar de la importancia de esta profesión, encontramos grandes lagunas a nivel nacional que impiden
su profesionalización.
El objetivo principal de esta investigación es poder definir el escenario y las medidas ideales que deben tomarse en España para la profesionalización de la Traducción e Interpretación en los Servicios Públicos (TISP), teniendo en cuenta cuatro puntos principales: el contexto jurídico de la figura del traductor e intérprete en los SSPP, los códigos deontológicos, el sistema de acreditación y los programas de formación. Este proyecto es un estudio comparativo del contexto español, australiano y canadiense que pretende extraer las similitudes y diferencias de los cuatro ejes señalados anteriormente.
La hipótesis que planteamos es que la falta de regularización y de profesionalización de la actividad de traductores e intérpretes en los SSPP supone una ausencia de leyes, normativas, código deontológico, sistema de acreditación y programas formativos homogeneizados a nivel nacional español que ayuden a establecer los derechos y deberes de estos profesionales. Para confirmar esta hipótesis trataremos diferentes puntos: 1. presentación del marco teórico en el que se encuadra nuestro estudio; 2. análisis comparativo de los diferentes puntos estudiados; y 3. presentación de los resultados y propuestas a nivel nacional. Los resultados obtenidos confirman la hipótesis de la ausencia de regularización conlleva la falta de homogeneización en cuanto a leyes, código deontológico, sistema de acreditación y programas formativos. Por último, ofrecemos una serie de reformas que han de tomarse a nivel jurídico, proponemos un modelo de código deontológico, enumeramos las características que ha de presentar un sistema de acreditación nacional y proporcionamos una lista de competencias que deben cubrirse en la formación de traductores e intérpretes. In recent years, there has been an increase in the migratory flow in Spain, and in the rest of the world. In many cases, these people do not know the language of the country of destination, thus they need linguistic and cultural assistance to be able to access the services offered by the Public Administration, as well as to be able to know and properly exercise their rights and duties. In this context of multiculturalism and regarding the need for linguistic and cultural assistance, the role of translators and interpreters in Public Services arises. However, despite the importance of this profession, there are still gaps at the national level that prevent its professionalisation.
The main objective of this research is to be able to define the ideal scenario and measures to be taken in Spain for the professionalisation of Translation and Interpreting in the Public Services, taking into account four main points: the legal context of the figure of the translator and interpreter in the Public Services, the codes of ethics, the accreditation system and the
training programmes. This project is a comparative study of the Spanish, Australian and
Canadian contexts that aims to extract the similarities and differences in the four areas aforementioned.
The hypothesis is that the lack of regularisation and professionalisation of the activity of translators and interpreters in the public services is due to the lack of standardised laws, regulations, code of ethics, accreditation system and training programmes at the Spanish national level, which would help to establish the rights and duties of these professionals. In order to confirm the hypothesis, we study four main points: 1. Presentation of the theoretical framework in which our study is framed; 2. Comparative analysis of the different points studied; and 3. Presentation of the results and proposals at national level. The results obtained confirm the hypothesis that the lack of regularisation leads to a lack of homogenisation in terms of laws, code of ethics, accreditation system and training programmes. Finally, we offer a series of reforms to be undertaken at the legal level, propose a model code of ethics, list the characteristics of a national accreditation system and provide a list of competencies to be covered in the training of translators and interpreters.
