Las tierras indígenas y la inversión extranjera. Aplicación del juicio de ponderación ante la Corte Interamericana de Derechos Humanos

Abstract

Informes temáticos evidencian que con la llegada del siglo XXI la exploración y la explotación a los recursos naturales aumentó significativamente en América Latina y el Caribe. Extracciones mineras y petroleras, así como la creación de monocultivos de caña de azúcar; palma de coco o soja han ocasionado altos impactos medio ambientales como también afectaciones a los derechos humanos en perjuicio de la población directamente afectada57. Para la presente investigación abordaremos este contexto con relación a los derechos humanos de las comunidades indígenas y grupos tribales que han sido vulnerados siendo la Corte Interamericana de Derechos Humanos (Corte IDH) una instancia regional el último mecanismo protección.

Thematic reports show that with the arrival of the 21st century, the exploration and exploitation of natural resources increased significantly in Latin America and the Caribbean. Mining and oil extraction, as well as the creation of sugar cane monocultures; coconut palm or soy have caused high environmental impacts as well as affect human rights to the detriment of the directly affected population. For this research, we will address this context with respect to indigenous communities and tribal groups where their rights have been violated and which therefore have gone before the Inter-American Court of Human Rights as the ultimate protection mechanism.
