dc.description.abstract | Una de las tareas más urgentes para aquellos que se dedican académicamente al Derecho Privado en China es la elaboración del Borrador del Código de Derecho Civil (en adelante, BCDC), entre el cual las teorías del contrato, del régimen jurídico contractual y la responsabilidad contractual son los trabajos más importantes. En el presente trabajo se presentan algunas consideraciones preliminares sobre los remedios indemnizatorios y la responsabilidad contractual, enfatizando en una visión de derecho comparado. El incumplimiento significa «cualquier falta de realización, realización irregular, defectuosa o incompleta de las conductas (prestaciones, si se prefiere) asumidas contractualmente». Pantaleón Prieto lo define en definitiva como «cualquier desviación del programa contractual». En relación con el remedio indemnizatorio, conviven dos posibles sistemas en el Derecho de la contratación: De un lado, los sistemas de corte subjetivo, que requieren un cierto grado de culpa del deudor, cuanto menos, para imputarle responsabilidad. De otro lado, los sistemas de corte objetivo, que permiten imputar responsabilidad al deudor en caso de incumplimiento, con independencia de la culpa, si bien puede quedar exonerado en caso de fuerza mayor o cuando quede fuera de su esfera de control el evitar el resultado dañoso. | es_ES |
dc.description.abstract | Actually the Draft of the Civil Code is one of the most urgent tasks for the Chinese jurists, among which the contract law is one of the most important works, including the contract liability theory, etc. This paper presents some preliminary considerations on compensation and contractual liability, from the perspectives of comparative law. The liability for breach of contract under the General Provisions of the Chinese Contract Law (GPCCL) is assumed to be the liability for the occurrence of a certain payment result: if the payment result does not occur or is not in compliance with the contract, it constitutes the so-called breach of contract in article 107 of the GPCCL. In the Spanish law, Pantaleón Prieto defines it as “any deviation from the contract process”. As for the remedies of damages, there are two possible systems in the contract law: one is the subjective system, which requires at least a certain degree of fault of the debtor in order to pursue its responsibility. On the other hand, the objective system allows the debtor to bear the responsibility in case of breach of contract, regardless of its fault, but in case of force majeure, or in case of the debtor’s uncontrollable situation, it can exempt its responsibility to avoid harmful consequences. | en |
