Abstract
En el presente trabajo se analizará cuál es el destino que tiene los bienes digitales generados por los usuarios en Internet para el caso de que sus titulares fallecieran. Para ello, vamos a analizar la perspectiva tradicional de la idea de sucesión y de herencia que está vigente en el derecho español para ampliarlo hacia una nueva idea que cada vez adquiere más relevancia como es la herencia y testamento digital. De esta manera, explicaremos que requisitos han de reunir los bienes para formar parte de un patrimonio que existe de forma digital con capacidad para ser heredado. Se procederá para ello a explicar la normativa vigente en nuestro ordenamiento que trata por primera vez de proteger en todo caso los derechos digitales del fallecido dotando al titular de la posibilidad de decidir si quiere determinar a un encargado de su gestión por testamento. In the present work, the destination of digital goods generated by users on the Internet will be analyzed in the event that their owners die. To do this, we are going to analyze the traditional perspective of the idea of succession and inheritance that is in force in Spanish law to expand it towards a new idea that is becoming more and more relevant, such as inheritance and digital will. In this way, we will explain what requirements the assets must meet to be part of a heritage that exists digitally with the capacity to be inherited. To do this, we will proceed to explain the regulations in force in our legal system that, for the first time, try to protect the digital rights of the deceased in any case, giving the owner the possibility of deciding if he wants to determine a person in charge of his management by will.
