Abstract
Más de 70 años después de su celebración, los procesos de Núremberg siguen
dado lugar a un apasionado debate entre los que defienden que en este Tribunal
Internacional sin precedentes se impartió verdadera Justicia a los criminales nazis
enjuiciados frente a los que ven en Núremberg únicamente una muestra más de la llamada
justicia de vencedores, de vencedores vengándose de los vencidos tras la guerra.
Tomando partido y tal como prepara un caso un abogado para defender a su
cliente, a lo largo de las páginas de este trabajo se van a examinar los entresijos de
Núremberg para constituir los argumentos de su defensa. Reflexionando sobre su origen,
el qué, el cómo y el porqué de lo que se juzgó en Nuremberg para defender lo sucedido
en Núremberg. Señalando sus carencias pero potenciando también sus aciertos, sacando
a relucir lo mejor de los procesos, su idea: la restauración en Europa del Estado de
Derecho tras el nazismo. Buscando en la Filosofía del Derecho el argumento definitivo
que permita, en ocasiones excepcionales como fue la de juzgar el horror nazi, que prime
la Justicia material sobre la formal. Todo, en defensa de este célebre cliente. More than 70 years after its celebration, the Nuremberg trials continue to give rise
to a passionate debate among those who argue that in this unprecedented International
Tribunal true justice was meted out to the Nazi criminals tried against those who seen in
Nuremberg only one more example of the called justice of victors, victors avenging the
vanquished after the war.
Taking sides and such as a lawyer prepares a case to defend his client, throughout
the pages of this work it will be examine the intricacies of Nuremberg to constitute the
arguments of his defense. Reflecting on its origin, the what, the how and the why of what
was judged at Nuremberg to defend what happened at Nuremberg. Pointing out its
shortcomings but also strengthening its successes, bringing out the best of the processes,
its idea: the restoration in Europe of the Rule of Law after Nazism. Seeking in the
Philosophy of Law the definitive argument that allows, on exceptional occasions such as
that of judging the Nazi horror, that material justice takes precedence over formal justice.
