El terrorismo yihadista y de ETA

Abstract

El presente trabajo ha sido realizado con el objetivo de estudiar el terrorismo yihadista y de ETA. Para ello, hemos partido de la búsqueda de su concepto en los instrumentos jurídicos internacionales, en el Código Penal español y en la jurisprudencia. A continuación, hacemos un análisis de la nueva regulación introducida por la Ley Orgánica 2/2015 de los delitos de terrorismo contemplados en los artículos 571 al 580 del Código Penal. Posteriormente, exponemos la política penitenciaria de los terroristas. Se explica su origen histórico, el derecho penitenciario y la concentración y dispersión de los presos de ETA, se relata los hechos del atentado del 11-M y algunos de los atentados más relevantes cometidos en Europa. Por último, este trabajo lo concluimos con el estudio de una nueva figura jurídica, la prisión permanente revisable, introducida por la Ley Orgánica 1/2015.

This project has been carried out with the aim of studying the Jihadism and ETA terrorism. On the one hand, we have started with the search for its concept in international legal instruments, in the Spanish Criminal Code and in jurisprudence. On the other hand, we’re making an analysis of the new regulation introduced by the Organic Law 2/2015 of the crimes of terrorism which has been considered by the articles 571 to 580 of the Criminal Code. In addition to this, we’re presenting the penitentiary politics of the terrorists. Its historical origin, the penitentiary law and the concentration and dispersion of the ETA prisoners, the facts of the 11-M attack and some of the most important attacks committed in Europe are told. Finally, we conclude with the study of the new legal figure, the reviewable permanent prison, introduced by the organic law 1/2015.
