Legítima defensa: estudio doctrinal y jurisprudencial

Abstract

La legítima defensa es una de las eximentes contempladas en el Código Penal. Da soporte a aquellas situaciones en las que el actor reacciona defendiéndose ante una agresión ilegítima, eximiéndole de los daños y perjuicios que pueda generar en dicha defensa y que de otra forma le supondría responsabilidad penal. También puede aminorar en otros casos la pena de no cumplirse todos sus requisitos, por lo que en estos casos puede actuar como eximente incompleta. Deja por lo tanto una puerta abierta para poder defender nuestros derechos y bienes en aquellos casos en los que el Estado no puede actuar, para así no quedar desamparados frente a situaciones injustas. En el presente trabajo procederemos a estudiar de una forma exhaustiva dicha figura, analizando los límites, sus requisitos y elementos, así como su evolución en el sistema español.

The self-defense is one of the exempt that is contemplated in the Criminal Code. It gives support to those situations in which the actor reacts by defending himself against an illegitimate aggression, exempt himself from the damages that he could generate in that defense and that otherwise it would suppose criminal responsibility. In other cases, it can also diminish the criminal responsibility in absence of all the requirements, which, in this case it can act like an incomplete exempt. Therefore, it leaves the door open to defend our rights and assets in those cases in which the State can´t act, so that we are not left helpless in unfair situations. In the present work we will proceed to study in a more comprehensive way that figure, analyzing its limits, its requirements and elements, as well as its evolutions in the Spanish system.
