Abstract
La Unión Europea resalta internacionalmente por aquellas particularidades que la hacen
única en el mundo. Poner de acuerdo a estados tan distintos como ocurre en la UE es
una tarea compleja, y ciertos temas han demostrado ser especialmente escabrosos para
lograr consenso, es el caso de la protección de los Derechos Humanos, y en particular
del derecho de Asilo. A esta complejidad se suma la existencia paralela del Consejo de
Europa, que reúne aún más estados en un mecanismo de cooperación internacional, mas
no de supranacionalidad, y con instrumentos de protección precisos como el Convenio
Europeo de Derechos Humanos y el Tribunal de Estrasburgo. Entre otros motivos, los
paralelismos entre las dos entidades han ralentizado la consolidación de los Derechos
Humanos en la UE. Hoy esta demuestra una incompetencia evidente a la hora de
gestionar la crisis de refugiados en los últimos años. El colectivo de solicitantes de
asilo, y ciudadanos europeos y del mundo, han estado en vilo ante la inacción de la UE,
preocupa aún más la situación de aquellos más vulnerables: los solicitantes de asilo
menores de edad no acompañados. The European Union stands out internationally because of the particularities that make it
unique in the world. Finding agreement amongst countries with such different
backgrounds as within the EU is a complex task, and certain topics have proved to be especially difficult to reach a consensus on. One example of this is the protection of
Human Rights, and particularly the Right of Asylum. Such complexity is increased by
the parallel existence of the Council of Europe, which brings together further more
states into an international cooperation mechanism, unlike the EU which is a
supranational entity. Moreover, it contains very precise protection instruments like the
European Convention on Human Rights and the Strasbourg Court. Amongst other
reasons, these parallelisms have slowed down the consolidation of Human Rights in the
EU, for example, proving the incompetence when having to manage the current refugee
crisis. Both the refugee cohort and European citizens have witnessed the inaction of the
EU in this crisis. Of greater concern is the situation of those most vulnerable: the
unaccompanied minors.
