Abstract
Actualmente el uso de la institución del indulto por el Gobierno en algunos casos genera polémica a nivel social, político y judicial, además existen dos corrientes doctrinales diferentes con respecto al control jurisdiccional del acto de concesión de un indulto, principalmente sobre la exigencia o no de su motivación, lo que provoca las siguientes preguntas: ¿La institución del indulto es susceptible de control jurisdiccional? y ¿si el control jurisdiccional actual del indulto es el adecuado?. La respuesta a estas dos preguntas es el objeto del presente trabajo, en el cual se analiza las características principales de la institución del indulto y su uso por el Poder Ejecutivo, la evolución del control jurisdiccional de esta institución por parte del Tribunal Constitucional y del Tribunal Supremo, incluyendo la doctrina tradicional y los últimos cambios producidos por dos sentencias del 2013, asimismo se observan algunas características del indulto en algunos países europeos de nuestro entorno, de países anglosajones y de determinados países iberoamericanos. At the moment the use of the institution of the pardon by the Government in some cases generates controversy in social, political and judicial level, in addition there are two different doctrinal currents with respect to the judicial control of the act of granting a pardon, mainly on the exigency or not of His motivation, which raises the following questions: Is the institution of pardon susceptible to judicial control? And if the current jurisdictional control of the pardon is adequate?. The answer to these two questions is the object of this paper, which analyzes the main characteristics of the institution of pardon and its use by the Executive, the evolution of the judicial control of this institution by the Constitutional Court and the Court Supreme, including the traditional doctrine and the latest changes produced by two sentences of 2013, also observe some characteristics of the pardon in some European countries of our surroundings, Anglo-Saxon countries and certain Ibero-American countries.
