Cohecho. Uno de los máximos exponentes de la corrupción

Abstract

El presente trabajo pretende llevar a cabo un estudio de la corrupción tratando en profundidad el delito de cohecho en todas sus vertientes. La definición de corrupción y el estudio de las causas de la misma que se lleva a cabo en los primeros capítulos darán una mejor visión del contenido del cohecho. Después de esto, analizando minuciosamente la tipificación actual y, por supuesto, las sucesivas reformas que desde el Código Penal de 1995 la han moldeado para dar su redacción, veremos cómo tanto los organismos nacionales como internacionales han ido regulando y avanzando en la lucha contra esta modalidad delictiva. Todo ello podremos verlo en los capítulos tercero y cuarto del presente trabajo. Una vez presentado el delito, nos centraremos en su estudio. En el capítulo quinto, se estudiaran todos aquellos elementos que son comunes a los delitos de cohecho, tales como el funcionario o autoridad pública, la dadiva o regalo o el bien jurídico protegido. Y ya después de esto nos centraremos en el estudio en profundidad de los artículos 419 a 427 bis del Código Penal con el fin de ofrecer una visión amplia y actual del delito en el que nos hemos centrado. En última instancia se aportaran las conclusiones a las que este alumno ha llegado en la realización del trabajo sobre su estudio de la corrupción.

This work aims to conduct a study of corruption addressed in depth the crime of bribery in all its forms. The definition of corruption and the study of the causes of it that takes place in the early chapters give a better view of the contents of bribery. After this, carefully analyzing the current characterization and, of course, successive reforms since the 1995 Penal Code have molded to give his writing, we will see how national and international agencies have been regulating and advancing the fight against this type of crime. All this we see in the third and fourth chapters of this work. Once presented the crime, we will focus on the study. In the fifth chapter, all those elements that are common to the crimes of bribery, such as official or public authority, the gift or the legally protected will be studied. And after this we will focus on in-depth study of Articles 419-427 bis of the Penal Code in order to provide a broad and current view of the crime in which we focused. Ultimately the conclusions that this pupil has come in the performance of work on the study of corruption are provided.
