El desistimiento unilateral : facultad del consumidor

Abstract

La Ley 3/2014, de 27 de marzo, ha modificado el Real Decreto Legislativo 1/2007, de 16 de noviembre, de Defensa de los Consumidores y Usuarios. Razón: la Directiva 83/2011, del Parlamente Europeo y del Consejo, de 25 de octubre, sobre los Derechos de los Consumidores, ha derogado la Directiva 577/1985, de 20 de diciembre, sobre contratos fuera del establecimiento mercantil del empresario, así como la Directiva 7/1997, de 20 de mayo, relativa a los contratos a distancia, y se ha adaptado a nuestro ordenamiento. De este modo se ha extendido el plazo de ejercicio del derecho de desistimiento, un derecho que extingue las obligaciones de las partes de ejecutar el contrato o de celebrarlo cuando el consumidor ha realizado una oferta. Para facilitar su ejercicio se ha introducido un modelo de formulario-tipo de desistimiento que el consumidor podrá completar incluso on-line a través de la página web del empresario. Aunque se sigue manteniendo el principio de libertad de forma para que aquel pueda desistir mediante una carta, llamada telefónica o simple devolución de los bienes recibidos. The Law 3/2014, of 27 March, modified the Royal Legislative Decree 1/2007, of 16 November, about Consumers and Users Defense. Reason: the Directive 2011/83/EU of the European Parliament and of the Council, of 25 October, on Consumers Rights, repealed Council Directive 85/577/EEC, of 20 December, to protect the consumer in respect of contracts negotiated away from business premises and Directive 97/7/EC, of 20 May, of the European Parliament and of The Council, on the protection of consumers in respect of distance contracts, and it has been adapted to our legal system. The period to withdraw is longer than before and the exercise of this right shall terminate the obligations of the parties to perform the contract or to conclude the distance or off-premises contract, in cases where an offer was made by the consumer. To facilitate its exercise the consumer may use a model withdrawal form and has the option to electronically fill in it on the trader`s website. He may withdraw using a letter, a telephone call or returning the received goods as well. But the burden of proof of exercising the right of withdrawal shall be on the consumer
