Abstract

This paper briefly describes the bankruptcy law effective in Uruguay since 2008. Former bankruptcy legislation established various proceedings considered over the decades to be inefficient, slow and expensive. The new law, drafted using the Spanish as a model, simplified and unified the bankruptcy regulations. It created a general procedure with a common initial stage, after which either an agreement (to allow the debtor to continue its business) or a liquidation phase can follow (both with a regime similar to the Spanish one). Despite some other differences with the Spanish law, under Uruguayan law restructuring agreements establishing debt¿swaps, debt reductions or different repayment schedules, (among other stipulations), can be reached. Once approved by a certain majority of creditors these agreements are binding virtually on all of them.
