El constitucionalismo español en su contexto comparado

Abstract

En este trabajo se examina el complejo y variado desarrollo del constitucionalismo español (sus textos, instituciones y doctrinas) con el propósito de situarlo en su contexto comparado, muy particularmente el europeo. Se estudian, así, entre otras cuestiones, el decisivo influjo de la Francia revolucionaria en la Constitución de Bayona y en la de Cádiz, la recepción del constitucionalismo inglés y francés post¿napoleónico durante el Trienio Liberal y los exilios habidos bajo el absolutismo fernandino, la influencia de la Gran Bretaña y, en menor medida, de Bélgica y de los Estados Unidos en la España constitucional desde 1834 hasta 1923, la huella del constitucionalismo de entreguerras durante la Segunda República y, en fin, las fuentes europeas, sobre todo alemanas e italianas, de la vigente Constitución de 1978. No se pasa por alto tampoco la proyección internacional de la Constitución de Cádiz y, con mucha menos intensidad, de la Constitución de 1931.

Abstract: This paper examines the complex and diverse development of spanish constitutionalism (its texts, institutions and doctrines) in order to see it in its context, especially the european context. The decisive influence of revolutionary France in the Constitution of Bayonne and the Constitution of Cadiz is studied in this way and, among other issues, also the reception of english and post¿napoleanic french constitutionalism during the Liberal Trienio and the exiles under the fernand absolutism, the influence of Great Britain and, to a fewer extend, Belgium and the United States of America on the constitutional Spain from 1834 to1923, the influence of constitutionalism between the First and the Second World War during the Second Republic of Spain and finally the european sources, especially french and german, that led to the valid constitution of 1978. The international projection of the constitution of Cadiz and, with less intensity, the constitution of 1931 are not either overseen.
