Abstract
El principio de desarrollo urbano sostenible tiene un largo recorrido en la evolución del derecho urbanístico, hasta su inclusión en nuestro ordenamiento jurídico. Este principio centrado en la utilización racional de los recursos prioriza el suelo por ser un recurso natural, limitado y no renovable, de ello deriva la trascendencia en la clasificación del suelo. Tanto la normativa como la jurisprudencia plasman la incidencia del Principio de Urbanismo Sostenible en la clasificación del suelo urbanizable y el no urbanizable de especial protección, ya que, impide el retroceso en la protección medioambiental. A pesar de ello al analizar las diversas sentencias de los tribunales españoles sobre la materia, se percibe como la planificación municipal, basándose en la potestad discrecional de la administración en materia de urbanismo, en múltiples ocasiones no ha respetado todo el contenido del principio, afectando gravemente al medioambiente. The principle of sustainable urban development has a long history in the evolution of urban planning law, until its inclusion in our legal system. This principle, which focuses on the rational use of resources, prioritises land as a natural, limited and non-renewable resource, which is why it is so important for land classification. Both legislation and case law reflect the impact of the Principle of Sustainable Urban Planning on the classification of land for development and land not for development under special protection, as it prevents any regression in environmental protection. In spite of this, when analysing the various rulings of the Spanish courts on the matter, it can be seen how municipal planning, based on the discretionary power of the administration in matters of town planning, has on many occasions not respected the full content of the principle, seriously affecting the environment.
