La atribución de la guarda y custodia en situaciones de violencia de género : ámbito nacional y europeo.

Abstract

En el presente trabajo se analizarán los diferentes conceptos de patria potestad y guarda custodia, ahondando en su terminología y caracteres. Estudiaremos el régimen de atribución de la guarda y custodia a los progenitores y como choca con las diferentes órdenes de protección y alejamiento. Asimismo, se examinará el mediático caso de Juana Rivas junto sus consecuencias penales y particularidades con respecto al derecho internacional. Otro de los aspectos que se van a tratar es la comparativa de los derechos de visitas y comunicaciones, atribución de la vivienda familiar y pensión de alimentos en términos de crisis familiar y cuando colisionan con situaciones de violencia de género.

In the present work, the different concepts of parental authority and custody will be analyzed, delving into their terminology and characters. We will study the regime of attribution of guardianship and custody to parents and how it clashes with the different orders of protection and restraint. Likewise, the mediatic case of Juana Rivas and its criminal consequences and its particularities with respect to international law will be examined. Another aspect that will be discussed is the comparison of the rights of visits and communications, attribution of the family home and alimony in terms of family crisis and when situations of gender violence occur.
