Abstract
The author defends (again, and until it is necessary) a strong conception of the constitutional principle of the Rule of Law and of the link between the legislator and the Constitution. If the Constitutional Court declares home confinement unconstitutional, and nothing happens, our Rule of Law and our Constitution are in serious trouble. This work maintains that people who suffered individualized damage as a result of this confinement (and other measures declared unconstitutional) have the right to be compensated. Upholding this thesis requires previously putting order in the confusing and contradictory jurisprudence of the Constitutional Court and the Supreme Court on the Liability of the legislator, clarifying what the current legislation says, rereading the ambiguous considerations of the STC 148/2021 on the effects of its own declaration of unconstitutionality and complete what STC 183/2021 does not say
