Abstract
Con el paso del tiempo, el ámbito que engloba la Propiedad Industrial y Propiedad
Intelectual ha ido aumentando debido a los avances industriales, al desarrollo de los
mercados y al desarrollo social. La consecuencia directa de esto, dentro del ámbito de la
industria textil, es el incremento de conflictos entre empresas, diseñadores y firmas por
la copia no legitima de los diseños. Es por ello por lo que los diseñadores necesitan
proteger sus creaciones frente a estas prácticas. El presente trabajo versa sobre la
protección que legalmente se confiere a los diseños de moda a través de la Propiedad
Industrial. Los diseños serán protegidos por dos vías: los diseños registrados y los diseños
no registrados. En el caso de la ropa, generalmente, obtendrán la protección por esta
segunda vía. Sin perjuicio de que, por la naturaleza y características del diseño, si de éste
se desprende suficiente originalidad, entre en la categoría de “obra de arte aplicado”, que
en ese caso gozará de la protección que otorga el Derecho de Autor, de manera acumulada
junto con la de la Propiedad Industrial. Over the years, the scope of Industrial Property and Intellectual Property has been
increasing due to industrial progress, market development and social development. The
direct consequence of this, within the field of the textile industry, is the increase of
conflicts between companies, designers and firms over the non-legitimate copying of
designs. For this reason, designers need to protect their creations against these practices.
The present work deals with the protection that is legally conferred on fashion designs
through Industrial Property. Designs will be protected in two ways: registered designs
and unregistered designs. In the case of clothing, they will generally obtain protection
through the latter. Without prejudice to the fact that, due to the nature and characteristics
of the design, if it is sufficiently original, it may fall into the category of "work of applied
art", which in that case will enjoy the protection granted by Copyright, cumulatively with
that of Industrial Property.
