Abstract
La situación actual de pandemia en la que nos encontramos inmersos causada por el virus
COVID--19, más conocido como coronavirus, está provocando un verdadero terremoto tanto a
nivel laboral como económico en nuestro país.
Esta situación de emergencia sanitaria causada por el COVID-19 ha provocado un gran reto
al ordenamiento jurídico en general y un gran despliegue de normativa en todas las ramas del
derecho, así, amparándose en el estado de alama, se han redactado una serie de decretos – leyes
basadas en el RDL 8/2020 de 17 de marzo. La finalidad de esta malgama normativa es luchar
contra el COVID-19, entre ellas, normas laborales y de seguridad social: flexibilización de los
expedientes de regulación temporal de empleo (a partir de ahora, ERTES); exoneración /
bonificación de cotizaciones a la Seguridad Social, medidas de protección del desempleo y el
cese de actividad de personas trabajadores por cuenta propia.
Todo este conglomerado normativo iba dirigido y tenía como objetivo fundamental la
defensa del empleo y el mantenimiento del mercado productivo durante la crisis para recuperar
y salvaguardar la actividad empresarial y proteger a los trabajadores tanto por cuenta ajena
como propia que hayan perdido su trabajo.
Como consecuencia de las limitaciones establecidas, millones de profesionales han sufrido
cambios en su actividad diaria, impidiéndoles acudir diariamente a su puesto de trabajo
obligándoles a teletrabajar. En cambio, hay ciertas actividades como restauración, transporte,
turismo, comercio, hostelería, construcción, ocio nocturno, entre otras, en los que se requiere
la presencialidad en el trabajo.
Una de las soluciones más impactantes que se adoptó en la mesa negociadora entre el
Gobierno y los agentes sociales, sindicatos y patronal, para asegurar la supervivencia de muchas
empresas, ya sean pymes o grandes multinacionales, fueron los ERTES.
Las empresas deben tener en cuenta que solo podrán acogerse a los ERTES en aquellos
casos en los que la supervivencia de su negocio se encuentre realmente afectada y en peligro y
siempre bajo el control y vigilancia de un concreto procedimiento en el que interviene la
autoridad laboral con el objetivo de garantizar el cumplimiento de todos los requisitos
legalmente establecidos para ello. The current pandemic situation in which we are immersed, caused by the COVID-19
virus, better known as coronavirus, is causing a real earthquake, at both, labor and economic
levels in our country.
This health emergency situation caused by COVID-19 has provoked a great challenge
to the legal system in general and also a great display of regulations in all the branches of law,
thus, taking refuge in the state of alarm, a series of decrees – laws based on RDL 8/2020 of
March 17, have been drafted. The purpose of this normative is to fight against COVID-19,
using, labor and Social Security norms: flexibilazation of temporary employment regulation
records (to from now on, ERTES); exoneration / reduction of contributions to the Social
Security, unemployment protection measures and the cessation of activity of freelance workers.
All this normative conglomerate was directed to and had as its fundamental objective
the defense of the employment and the maintenance of the productive market during the crisis,
to recover and safeguard business activity and protect both, freelance workers and employed
people, who have lost their Jobs.
As a consequence of the established limitations, millions of professionals have suffered
changes in their daily activity, which prevented them from going daily to their work and
obligied them to telecommute. Instead, there are certain activities such as restaurant business
transportation, tourism, commerce, hostelry, construction, nightlife, among others, which
require presence at work.
One of the most impressive solutions adopted at the negotiating table between the
Government and social agents, unions and employers, to ensure the survival of many
companies, whether SMEs or large multinationals, were ERTES.
Companies must take into account that they will only be able to benefit from ERTES in
those cases, in which the survival of their business is really affected and endangered. And that
It should always be under the control and surveillance of a specific procedure in which the
labour authority intervenes with the aim of guaranteeing compliance with all the legally
established requirements for it.
