Abstract
La gestación subrogada, también denominada, como gestación por sustitución, es uno de los supuestos jurídicos más controvertidos de nuestra era. A largo del presente trabajo, y tras presentar una visión global sobre la situación actual de la materia en el marco jurídico español, se procederá a estudiar la jurisprudencia existente sobre la gestación por sustitución, tanto el ámbito nacional como en el europeo a través del análisis de resoluciones judiciales de diversos órganos.
Así, será de suma importancia el estudio de las resoluciones que emanan del Tribunal Supremo, de las Audiencias Provinciales o incluso las sentencias procedentes de los Juzgados de Primera Instancia. También se abordará el análisis de alguna de las sentencias que emana del Tribunal Europeo de Derechos Humanos o incluso ciertas resoluciones del Tribunal de Justicia de la Unión Europea que han arrojado luz sobre la materia.
Asimismo, será de incipiente importancia relacionar estas resoluciones judiciales con otras de índole administrativa, como las que dicta la Dirección General de Registros y Notariado, sobre la posible y la eventual inscripción de esta institución en el Registro Civil español. Surrogacy, is one of the most legally controversial assumptions of our era. Throughout this work, and after presenting a global vision on the current situation of the matter in the Spanish legal framework, we will proceed to study the existing jurisprudence on surrogacy, both the national and European level through analysis of judicial decisions of various bodies.
Thus, it will be of utmost importance to study the decisions emanating from the Supreme Court, provincial courts or even the judgments of courts of first instance. It will also deal with some of the judgments emanating from the European Court of Human Rights or even certain decisions of the Court of Justice of the European Union that have shed light on the matter.
Likewise, it will be important to relate these judicial decisions with others of an administrative nature, such as those issued by the General Directorate of Registries and Notaries, on the possible and eventual registration of this institution in the Spanish Civil Registry.
