Abstract
El Virus de la Inmunodeficiencia Humana, más conocido como VIH, es un
retrovirus que ataca y daña a los linfocitos CD4 provocando así que el sistema
inmunológico fabrique menos anticuerpos para combatir las infecciones provocadas por
cuerpos externos. Esta enfermedad ha supuesto desde el día en que se conoció su
existencia hasta la actualidad, una discriminación hacia el colectivo de personas que
tienen VIH por miedo a “contagiarse” implicando así, la vulneración del derecho a la
igualdad y a la no prohibición de discriminación derecho fundamental que viene recogido
en el artículo 14 CE. El objetivo de este trabajo es analizar qué papel juega la enfermedad
del VIH dentro de la esfera laboral, y en concreto, dentro de las posibles causas que
pueden motivar el despido del trabajador. Inicialmente, veremos a través de un método
explorativo y genérico todo el desglose de la regulación española acerca del despido,
donde veremos los tipos existentes, así como sus calificaciones. Una vez visto esto,
exploraremos la interrogativa de si una enfermedad puede considerarse causa de despido
a través de la STC 62/2008, del 26 de mayo. Finalmente, aplicaremos los dos puntos
anteriores a la figura del VIH en el trabajo con el fin de vislumbrar las causas que
provocan o no el despido por esta enfermedad, así como las consecuencias que lleva
consigo y de los derechos que participan y se ven vulnerados.

Humana. Human immunodeficiency virus, better known as HIV, is a retrovirus which
attacks and damages CD4 lymphocyte, causing immune system to create less antibodys
able to fight infections caused by foreign bodies. This disease has been causing from the
very first day when its existence was known till nowdays many cases of discrimination
to those people suffering from HIV or AIDS; discrimination caused by the fear to get
"infected" by them, implying as a result the infringement of equality rights, and also to
the fundamental right to not being discriminated against as stipulated at article 14 CE.

The main objective of this research work is to analyze the role of this disease inside
working enviroment, and to be more specific, looking for possible reasons that can
motivate an employee to be fired. First, we will see through an exploratory and generic
method all the itemization of spanish regulation about firing a person, where we will see
different existing types and its qualifications also. Next, we´ll explore the interrogative
about if a disease like HIV can be considered a reason to fire a person, through STC
62/2008, May 26th. And finally, we will use both previous items over HIV at a job
enviroment, to be able to glimpse the causes that provokes or not to be fired for this
disease, as the results caused by it, and also about rights taking part and being infringed.
