Abstract
El presente trabajo analiza la violencia digital en el ámbito de la violencia de género, o la
también llamada e-violencia de género, es decir, aquella que se proyecta sobre las mujeres por
parte de quienes sean o hayan sido sus cónyuges, o de quienes tengan o hayan tenido relaciones
similares de afectividad con ellas. La implantación generalizada de los medios digitales en las
relaciones sociales y afectivas abre la posibilidad de nuevas formas de comisión de delitos, de
tal forma que conductas delictivas ya tipificadas hace muchos años cambian en su forma de
realización, y también surgen nuevos tipos penales para castigar conductas antijurídicas
aparecidas con la utilización cotidiana de las nuevas tecnologías (TIC). Por esa razón, la parte
principal de este trabajo supone el análisis de los diferentes tipos delictivos y un resumen de los
supuestos más relevantes enjuiciados por nuestros tribunales, con el objetivo de verificar la
aplicación e interpretación de los diferentes comportamientos que se pueden producir en este
fenómeno delictivo. This work analyzes digital violence in the field of gender violence, or the denominated egender
violence, that means the one which is projected on women by those who are or have
been their spouses, or by who have or have had similar emotional relationships with them. The
widespread implementation of digital media in social and affective relationships opens up the
possibility of new ways of committing crimes, in such a way that criminal behaviors already
typified many years ago change in their way of being carried out, and new criminal types also
emerge to punish unlawful behaviors that appear with the daily use of new technologies (ICT).
For this reason, the main part of this work involves the analysis of the different criminal types
and a summary of the most relevant assumptions prosecuted by our courts, with the aim of
verifying the application and interpretation of the different behaviors that can occur in this
criminal phenomenon.
