Abstract
El artículo 245.2 del Código penal castiga la ocupación pacífica de inmuebles, viviendas o edificios que no constituyan morada y el mantenimiento en los mismos contra la voluntad de sus titulares con la pena de multa de tres a seis meses. Se pretende dar protección a los bienes jurídicos de posesión y derechos de uso sobre el patrimonio inmobiliario. En cuanto a los medios comisivos, se exige que la ocupación se realice en ausencia de violencia o intimidación y, al ser un delito común, podrá ser realizado por cualquier persona, salvo el propietario o titular del derecho real. El sujeto pasivo en este delito podrá ser cualquier persona que tenga faculta de disposición sobre el inmueble. En el tipo objetivo de este delito, la doctrina sostiene que se deben dar los elementos de ánimo de lucro, actuar en concepto de dueño y utilidad obtenida. Se exige también la concurrencia de dolo en el sujeto activo, esto es, que el autor tenga conocimiento de que el bien es ajeno, así como de la ausencia de autorización o de la manifestación de oposición del legítimo titular. Las causas de justificación de legítima defensa, estado de necesidad o cumplimiento de un deber o ejercicio legítimo de un derecho, oficio o cargo pueden eliminar la antijuridicidad de los actos, tanto del sujeto activo como del sujeto pasivo en las ocupaciones pacíficas. Veremos qué posibilidades de actuación posee el titular del bien inmueble ocupado para recuperar la posesión de éste a través de procedimientos civiles como la acción de desahucio por precario, el juicio verbal para la efectividad de los derechos reales inscritos y la acción reivindicatoria. Finalmente, expondremos una propuesta de lege ferenda para una nueva redacción del artículo 245 del Código penal, así como otros artículos que afectan a la usurpación de bienes inmuebles. Article 245.2 of the Penal Code punishes the peaceful occupation of real estate, dwellings or buildings that do not constitute a dwelling and the maintenance in them against the will of their owners with the penalty of a fine of three to six months. It is intended to give protection to the legal assets of possession and rights of use over real estate assets. As for the commissive means, it is required that the occupation be carried out in the absence of
violence or intimidation and, as it is a common crime, it can be carried out by anyone except the owner or owner of the real right. The passive subject in this crime may be any person who has the power to dispose of the property. In the objective type of this crime, the doctrine maintains that the elements of profit motive must be given, act as owner and utility obtained. The concurrence of fraud in the active subject is also required, that is, that the author has knowledge of the alienation of the property, as well as the absence of authorization or the manifestation of opposition of the legitimate owner. The causes of justification of legitimate defense, state of necessity or fulfillment of a duty or legitimate exercise of a right, office or position can eliminate the illegality of the acts of both the active subject and the passive subject in peaceful occupations. We will see what possibilities of action the owner of the occupied property has to recover possession of it through civil procedures such as the precarious eviction action, the verbal trial for the effectiveness of the registered real rights and the claim action. Finally, we will expose a lege ferenda proposal for a new wording of article 245 of the Criminal Code, as well as other articles that affect the usurpation of real estate.
