Abstract
El sistema de estimación objetiva para la cuantificación de la base imponible del Impuesto sobre la Renta de las personas Físicas (IRPF), aplicable a determinadas actividades económicas, presenta grandes ventajas, sobre todo por su sencillez administrativa, sin embargo, su aplicación tiene problemas. Desde hace años se estima que este régimen permite esconder una gran parte de la economía sumergida debido a que no existe una gran exigencia de registro de facturas, lo que puede facilitar conductas fraudulentas. Se estima que la aplicación del sistema de módulos conduce a un gravamen inferior para los autónomos que se acogen al mismo, frente a los que eligen la estimación directa de sus bases imponibles. Otro inconveniente es su falta de flexibilidad en diferentes situaciones económicas. Este problema se ha agudizado durante la pandemia sufrida en 2020 cuando los ingresos de la mayor parte de los trabajadores autónomos se han reducido de forma significativa, en muchos casos a cero. En este trabajo se estudia el sistema de estimación objetiva analizando los problemas que plantea su aplicación. Estos problemas ya se habían constatado en los últimos años, realizándose diversas modificaciones en el sistema, pero la pandemia ha evidenciado su debilidad, provocando su suspensión temporal. The objective estimation system for the quantification of the tax base of the Personal
Income Tax (IRPF), applicable to certain economic activities, has great advantages, especially
due to its administrative simplicity, however, its application has problems. For years it has been
estimated that, under this regime, a large part of the underground economy can be hidden due to
the fact that there is not a great requirement to register invoices, which can facilitate fraudulent
behavior. In addition, it is estimated that the application of the module system leads to a lower tax
for the self-employed who take advantage of it, compared to those who choose the direct estimate
of their tax bases. Another drawback is its lack of flexibility in different economic situations. This
problem has become even more evident during the pandemic in 2020 in which the income of most
of the self-employed fell significantly, in many cases to zero. In this work, the objective estimation system is studied in depth, analyzing the problems posed by its application. These problems had already been noted in recent years, with various modifications being made to the system, but the pandemic has shown its weakness, causing it to be temporarily suspended.
