dc.description.abstract | En el presente trabajo se realiza un estudio sobre las consideraciones generales de la contratación electrónica. El contrato electrónico es aquel celebrado entre personas distantes geográficamente que por medios electrónicos manifiestan la oferta y la aceptación.
La norma principal que actúa de base normativa en la contratación electrónica es la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico.
Asimismo, el trabajo se centra en analizar la formación del contrato electrónico, dividiendo su estudio a través de los tres elementos esenciales sin los cuales el contrato no puede existir: consentimiento, objeto y causa. En suma, ofrece un amplio desarrollo sobre los criterios principales de la oferta y la aceptación como figuras imprescindibles en todo contrato electrónico, ya que todo contrato se inicia con una oferta de una de las partes y finaliza con la aceptación por la otra parte contratante.
También se desarrollan el documento electrónico y la firma electrónica que actúan garantizando la seguridad y la veracidad en el comercio electrónico y, por último, se hace especial mención a la figura del tercero de confianza en los servicios electrónicos. | es_ES |
dc.description.abstract | In the present work, a study is carried out about the general considerations of electronic contracting. The electronic contract concluded between people separated geographically and who, consequently, manifest electronically the offer and its acceptance.
The main norm that acts as a normative basis in electronic contracting is the Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce.
Likewise, the work focuses on analyzing the formation of the electronic contract; dividing its study into the three essential elements for the correct development of the contract: consent, object and cause. In short, it offers a broad development on the main criteria of the offer and acceptance as indispensable figures in any electronic contract, since every contract starts with an offer from one of the parties and conclude with the acceptance by the other party contracted.
Furthermore, on the other hand, the electronic document and the electronic signature that act guaranteeing security and veracity in electronic commerce are also developed and, finally, special mention is made of the figure of the trusted third party in electronic services. | en |
