Abstract
El presente estudio analiza el fenómeno de la Sección Sindical, desde el punto de vista de su actuación en la empresa, como órgano titular de la representación sindical en ella. Se aporta un recorrido histórico, desde los primeros instrumentos de representación y defensa de los intereses de los trabajadores frente al empresario, hasta la concepción del doble canal de representación vigente en nuestro ordenamiento jurídico. Se definen las claves de la representación unitaria y sindical, con sus diferencias y paralelismos, así como la interacción entre sus órganos electos. Y se delimita el alcance de las funciones, derechos y competencias que la LOLS atribuye a la Sección Sindical y a su representante interno, el Delegado Sindical. Todo ello, acompañado de la doctrina y la jurisprudencia dictada por los Tribunales durante los casi cuarenta años de vigencia de esta norma, vertebrando el sistema de representación de los trabajadores que rige en la actualidad. This study analyses the phenomenon of the Trade Union Section, from the point of view of its action in the company, as the body responsible for trade union representation in the company. A historical overview is provided, from the first instruments of representation and defense of workers' interests against the employer, to the conception of the “dual channel of representation” in force in our legal system. The keys to unitary and trade union representation are defined, with their differences and parallels, as well as the interaction between their elected bodies. And the scope of the functions, rights and competences that the LOLS attributes to the Trade Union Section and its internal representative, the Trade Union Delegate, are delimited. All of this is accompanied by the doctrine and case law dictated by the Courts during the almost forty years that this regulation has been in force, structuring the system of worker representation that currently governs.
