Abstract
In the present work we analyze the practice, not technical, known as surrogacy
and the normalization that has been granted throughout these years. To do this, we start
with a brief study of historical and legal antecedents where we find traces from 1910 BC.
in the Old Testament, continuing through Mesopotamia in the Code of King Hammurabi,
until its normalization in our most current laws.
In later lines, we investigate through a doctrinal analysis of several authors, the
conceptualization of this figure, the social aspects regarding the relationships between the
contractors, the bioethical and biomedical dimension of this business and we will delve
into the psychological and harmful consequences that derive from this same practice.
It has also been necessary to prepare a legislative study, which analyzes the role
of surrogacy since the Spanish Constitution of 1978, as in Law 14/2006 of May 26, on
assisted human reproduction techniques, where this is supposedly regulated. practice,
until the Instruction of October 5, 2010 of the General Directorate of Registries and
Notaries, which supposedly is issued to provide full legal protection to the minor.
To finalize the study carried out, it has been of great relevance to make a brief
jurisprudential analysis of the Spanish Courts, the European Court of Human Rights and
the Court of Justice of the European Union, extracting doctrine, from the most important
judgments, which has caused a standardization of this practice.
