dc.description.abstractLa tardanza en la obtención de un pronunciamiento por parte de los Tribunales puede dar lugar a la vulneración del artículo 24 de la Constitución Española (CE), tanto en su apartado primero, en el cual se regula el derecho de todos los ciudadanos a la tutela judicial efectiva, como en su apartado segundo, que reconoce el derecho de todos los ciudadanos a un proceso público y sin dilaciones indebidas, junto con sus garantías. Este trabajo de fin de máster se centrará en las dilaciones indebidas, concepto jurídico indeterminado y de entendimiento negativo, por consiguiente, todo lo relacionado con un proceso que se ve indebidamente prolongado en el tiempo, causando un perjuicio. Este derecho a un proceso sin dilaciones indebidas fue contemplado por primera vez por parte del Tribunal Constitucional en su Sentencia 24/1981, de 14 de julio. La doctrina ha construido los criterios que se deben tener en cuenta para la apreciación de la vulneración de dicho derecho, no siendo suficiente la demora en el tiempo. La apreciación de la vulneración del derecho a un proceso sin dilaciones indebidas podrá conllevar la responsabilidad patrimonial del Estado a consecuencia del anormal funcionamiento de la Administración de Justicia.es_ES
dc.description.abstractThe delay in obtaining a ruling by the Courts may lead to the violation of article 24 of the Spanish Constitution (SC), both in its first section, which regulates the right of all citizens, to effective judicial protection, as in its second section, that recognizes the right of all citizens to a public process and without undue delay, together with its guarantees. This master's thesis will focus on undue delays, an indeterminate legal concept and negative understanding, that occurs when a process is prolonged in time, causing damage. This right to a trial without undue delay was considered for the first time by the Constitutional Court in its STC 24/1981, of July 14. The doctrine has built the criteria that must be considered for the appreciation of the violation of said right, not being sufficient the delay in time. The appreciation of the violation of the right to a trial without undue delay may entail the patrimonial responsibility of the State as a result of the abnormal functioning of the Administration of Justice.en
