El derecho a la alimentación conforme a las creencias profesadas en los centros de internamiento de menores

Abstract

La finalidad principal del presente trabajo es, en primer lugar, profundizar en el estudio del derecho de libertad religiosa en los centros de internamiento de menores y, en segundo lugar, determinar el alcance del contenido de este derecho, pues éste no finaliza con la mera asistencia a las celebraciones religiosas que cada confesión tenga estipuladas, sino que va más allá y contiene numerosas manifestaciones, como por ejemplo la que tratamos en este trabajo de forma particular: la alimentación conforme a las creencias religiosas, respetando las prescripciones de cada confesión. Analizaremos también, cuál deberá ser el proceder de los menores internos para poder recibir asistencia religiosa en los centros de internamiento y cuál deberá ser la postura de la Administración responsable, ya que debemos tener en cuenta que existen determinados límites en el ejercicio de todos los derechos, incluso cuando hablamos de derechos fundamentales, y, con más motivo todavía, cuando existe una condena de privación de libertad con el objetivo de garantizar el orden del centro de internamiento, y el respeto de los derechos del resto de reclusos.

The main purpose of this work is, firstly, to deepen the study of the right to religious freedom in juvenile detention centers, and, secondly, to determine the range of the content of this right, because this right does not end with the sheer attendance at the religious celebrations that each confession has stipulated, but goes further and contains numerous manifestations, such as the one that we deal with in this work in a particular way, food according to religious beliefs, respecting the prescriptions of each confession. We will also analyze what should be the process of the inmate minors to be able to receive religious assistance in the juvenile detention centers and what should be the position of the Administration, since we must take in to account that there are some limits in the exercise of all rights, even when we speak of fundamental rights, and, even more so, when there is a sentence of deprivation of liberty in order to guarantee the order of the juvenile detention center, and respect for the rights of the rest of the inmates.
