Abstract
La violencia de género es uno de los problemas que más dificultades crea a la hora de legislar buscando la protección de las víctimas, puesto que ocurre en el marco de las relaciones personales en el ámbito familiar, lo cual, sumado al fuerte impacto psicológico y social que genera en las víctimas, dificulta su protección. En numerosos casos las víctimas no denuncian, y si lo hacen, más tarde se niegan a declarar o incluso cuando se interponen medidas para su protección son ellas mismas quienes consienten en seguir manteniendo contacto o hasta reanudan la convivencia con su agresor.
El presente trabajo tiene por objeto abordar el estudio del delito de quebrantamiento tipificado en el art. 468.2 del Código Penal y, en concreto, en aquellos supuestos en los que la víctima de violencia de género presta su consentimiento para que dicho quebrantamiento se lleve a cabo. Trataremos de dar respuesta a las cuestiones que dicha problemática pueda plantear combinando el punto de vista doctrinal con la
jurisprudencia, tanto del Tribunal Supremo como de las distintas Audiencias Provinciales. Gender violence is one of the problems that creates the most difficulties when it comes to legislating for the protection of victims, this is because it occurs in personal relationships in the family environment, which, added to the strong psychological and social impact it generates on the victims, makes their protection difficult. In many cases the victims don´t report and if they do, they later refuse to testify, or even when measures are interposed for their protection, it is they themselves who agree to continue maintaining contact or even resuming living when their aggressor. The present work aims to address the study of the crime of breaking the article
468.2 CP and, specifically, in those cases in which the victim of gender violence gives their consent for said violation to take place. We will try to answer the questions that this problem may raise, combining the doctrinal point of view with the jurisprudence, both of the Supreme Court and of the different Provincial Courts.
