Dictamen jurídico : la gestación subrogada

Abstract

El presente trabajo tiene por objeto dar respuesta a la consulta de una pareja que ante la imposibilidad de tener hijos acude a la gestación subrogada en un país extranjero. Para ello, partiremos del estudio conceptual de la “gestación subrogada”. Después, pasaremos a analizar la normativa internacional, examinando las diferencias existentes entre la normativa de los diversos países y la normativa española, y estudiaremos en profundidad los países donde los contratos de gestación por sustitución son legales. Posteriormente, se analizará la regulación en el ordenamiento jurídico español, especialmente las distintas resoluciones dictadas por la Dirección General de los Registros y del Notariado y la doctrina del Tribunal Supremo, haciendo especial referencia a los problemas de filiación que plantea la gestación subrogada en nuestro país. Finalmente, se examinará la jurisprudencia del Tribunal Europeo de Derecho Humanos y se dará solución a las cuestiones planteadas.

The purpose of this paper is to respond to the query of a couple who, faced with the impossibility of having children, go to surrogacy in a foreign country. To do this, we will start from the conceptual study of "surrogacy". Then we will go on to analyze international regulations and examine the differences between the regulations of the various countries and the Spanish regulations, studying in depth the countries where surrogacy contracts are legal. Afterwards, the regulation in the Spanish legal system will be analyzed, especially the different resolutions and Instructions issued by the General Directorate of Registries and Notaries and the doctrine of the Supreme Court, making special reference to the problems of filiation posed by surrogacy in our country. Finally, the jurisprudence of the European Court of Human Rights will be examined and the questions raised will be resolved.
