Abstract
El presente artículo analiza el papel institucional de la OIT en el modelo de gobernanza
del trabajo, destacando la orientación futura de la acción normativa internacional, así
como los programas específicos de acción de dicha institución internacional. Este
estudio intenta presentar los fundamentos necesarios de un renovado contrato social
relativo al trabajo protegido y con derechos. En este sentido, se aboga por la protección
del trabajo desde la propia perspectiva de la garantía de los Estados Sociales de
Derecho, ante la actual situación de crisis económica y social. Ciertamente, nos
encontramos ante una necesidad de alcanzar un nuevo modelo de gobernanza del
trabajo, basado en dar respuesta a los retos relativos al futuro del trabajo y, todo ello, sin
descuidar la necesaria tutela de los derechos fundamentales internacionales. Por tanto,
es esencial seguir enfatizando la necesidad de alcanzar una renovada gobernanza laboral
internacional. En definitiva, se trata de reafirmar el tradicional principio de justicia
social, acuñado por la comunidad internacional en 1919, con motivo de la negociación
del Tratado de Versalles. This paper analyzes the institutional role of the ILO in the labor governance model. The
future orientation of international normative action is highlighted, as well as the specific
action programs of aforementioned international institution. This study tries to present
the necessary foundations of a renewed social contract related to protected work and
rights. In this sense, the protection of work is advocated from the perspective of the
guarantee of the Social States of Law, in the current situation of economic and social
crisis. Certainly, we are faced with a need to achieve a new model of work governance
based on responding to the challenges related to the future of work. We must not
neglect the necessary protection of fundamental international rights. Therefore, it is
essential to continue to emphasize the need to achieve renewed international labor
governance. Ultimately, it is about reaffirming the traditional principle of social justice,
settled by the international community in 1919, on the occasion of the negotiation of the
Treaty of Versailles.
