La interpretación jurídica en España: análisis de la profesión y recomendaciones para la creación de un código ético oficial aplicable al contexto español

Abstract

En los últimos años, España ha pasado de ser un país de emigración, a ser uno de los principales receptores de inmigrantes de Europa. De hecho, los inmigrantes representan casi el 10% de la población española. Como consecuencia, han surgido unas necesidades y carencias relacionadas con la comunicación y convivencia intercultural. La interpretación, traducción y mediación intercultural son esenciales para garantizar el derecho a entender y ser entendido de este sector de la población. Sin embargo, no existe una normativa profesional ni un código ético oficial que sirva de guía para estos profesionales. La hipótesis que se plantea en este trabajo es que en España existe la necesidad de regular la profesión de traducción e interpretación en los servicios públicos, así como de instaurar un código ético oficial. Para confirmar esta hipótesis, los objetivos de esta investigación incluyen el análisis de la situación de la interpretación en los servicios públicos en general y de la interpretación jurídica en particular y de la necesidad de instaurar un código ético oficial en España para, más tarde, en base a un análisis específico de códigos éticos tanto nacionales (no oficiales), como internacionales, proponer una serie de recomendaciones para la creación de un código ético oficial unificado aplicable al contexto español. Además, se analizarán también los códigos éticos en profundidad, tanto su estructura y contenido como su utilidad. Gracias a esta metodología exploratoria y teórico-descriptiva, se concluye que la mayoría de los códigos éticos, pese a diferir en algunos aspectos, comparten los principios más importantes (confidencialidad, precisión, imparcialidad, solidaridad profesional, etc.) y que, en efecto, son necesarios. Por ello, se recalcan la necesidad de crear un código oficial español y se aportan recomendaciones específicas para su creación. In recent years, Spain has grown from being a country of emigration to being one of the main receivers of immigrants in Europe. In fact, immigrants represent almost 10% of the Spanish population. As a result, some needs and shortages related to intercultural communication and coexistence have emerged. Interpretation, translation and intercultural mediation are essential to guarantee the right to understand and to be understood of this sector of the population. However, there is no professional regulation or official code of ethics that these professionals may use as a guide. The hypothesis presented in this study is that there is a need to regulate the profession of public service translation and interpreting in Spain, as well as to establish an official code of ethics. To confirm this hypothesis, the objectives of this research include the analysis of the situation of interpreting in public services in general and of that of the legal interpretation in particular and the analysis of the need to establish an official code of ethics in Spain. Then, based on a specific analysis of both national (non-official) and international codes of ethics, the goal is to propose a series of recommendations for the creation of a unified official code of ethics applicable to the Spanish context. In addition, ethical codes will also be thoroughly analysed, both in terms of their structure and content as well as their usefulness. Thanks to this exploratory and theoretical-descriptive methodology, the study concludes that the majority of ethical codes, despite differing in some aspects, share the most important principles (confidentiality, precision, impartiality, professional solidarity, etc.) and that they are, indeed, necessary. For this reason, the need to create an official Spanish code of ethics is stressed and specific recommendations for its creation are provided. In addition, the need to regulate and professionalize translation and interpretation in public services is also confirmed.
