dc.description.abstractLa hipótesis de partida del presente trabajo parte del hecho ostensible de que la transmisión del derecho en España da muestras de opacidad que se perciben en el nivel lingüístico y el comunicativo. El presente trabajo ha partido de dos objetivos iniciales: el primero es el de analizar la dimensión lingüística y comunicativa de los documentos jurídicos españoles, pertenecientes al corpus monolingüe que se ha confeccionado, para lo que se han seleccionado unas muestras de opacidad de carácter semántico, morfosintáctico y pragmático, puestas en relación con los elementos comunicativos. El segundo consiste en la comparativa de las propuestas de la CMLJ y del Plain legal English mediante un corpus bilingüe que ha producido equivalencias traductológicas, las cuales posteriormente se han contrastado con las soluciones que ha propuesto el presente trabajo. Todo ello ha servido para llegar a un objetivo final, el de reivindicar la figura del traductor jurídico como figura competente para promover la comunicación clara del derecho por participar activamente en los ámbitos implicados. En base a los resultados obtenidos, se ha demostrado que los postulados de la CMLJ y el Plain legal English no son satisfactorios, sobre todo en lo que respecta a la dimensión pragmática y comunicativa; y que las muestras de opacidad localizadas han cumplido la hipótesis inicial.es
dc.description.abstractThe starting hypothesis of the present work is based on the ostensible fact that the transmission of the right in Spain shows signs of opacity that are perceived at the linguistic and communicative level. The present work has started from two initial objectives: the first one is to analyze the linguistic and communicative dimension of the Spanish legal documents, belonging to the monolingual corpus that has been made, for which some opacity samples of semantic, morphosyntactic and pragmatic character have been selected, put in relation with the communicative elements. The second consists of a comparison of the proposals of the CMLJ and the Plain legal English by means of a bilingual corpus that has produced translatological equivalences, which have subsequently been contrasted with the solutions proposed in this work. All this has served to reach a final objective, that of claiming the figure of the legal translator as a competent figure to promote clear communication of the law by actively participating in the fields involved. On the basis of the results obtained, it has been demonstrated that the postulates of the CMLJ and the Plain legal English are not satisfactory, above all with regard to the pragmatic and communicative dimension; and that the samples of opacity located have fulfilled the initial hypothesis.en
