El acuerdo extrajudicial de pagos

Abstract

El presente trabajo de fin de Máster, tiene como objetivo estudiar y analizar de forma sistemática la institución preconcursal del Acuerdo extrajudicial de pagos, considerando su regulación de Ley Concursal y también el recién publicado y extenso nuevo Texto Refundido de la Ley concursal. El objetivo es analizar en profundidad la materia, para así poder supervisar, asesorar e incluso orientar la utilización, de la mejor forma, de las herramientas que ofrece para la consecución del éxito del mejor acuerdo posible. Se analizan las distintas las fases y procedimiento del Acuerdo extrajudicial de pagos, así como la problemática de la falta de regulación normativa en algunos aspectos y soluciones facilitadas a través de la jurisprudencia, hasta la finalización del acuerdo. Ante la posibilidad de que el incumplimiento del Acuerdo derive en un concurso consecutivo, analizamos tal eventualidad y el procedimiento aplicable. Por último, incluimos unos breves comentarios relativos a las circunstancias de los últimos meses relacionadas con el COVID-19, afectación a nuestro sistema y regulación al respecto.

The purpose of this Master's Thesis is to study and analyze the pre-bankruptcy institution of the out-of-court payment agreement in a systematic way, not only through its Bankruptcy Law regulation but also from the recently published and extensive new Consolidated Text of the Law bankruptcy. The objective is to know the subject in depth, in order to be able to supervise, advise and even guide the use of the tools it offers in the best way, to achieve the success of the best possible agreement. All its phases and procedures are analyzed, as well as the problem of the lack of regulatory regulation in some aspects and solutions provided through jurisprudence, until the agreement is finalized. Given the possibility that it could lead to a consecutive contest, we analyzed the procedure. Lastly, we make a few brief comments regarding the circumstances of the last few months related to COVID-19, impact on our system and regulations in this regard.
