Ordenación del tiempo de trabajo y Unión Europea

Abstract

Este trabajo tiene como finalidad el análisis del Régimen Jurídico aplicable al tiempo de trabajo a través del estudio de la Directiva 2003/88 reguladora de la materia así como su transposición al ordenamiento jurídico Español. Para ello acudiremos a las disposiciones contenidas en la norma europea relativas a la duración máxima del tiempo de trabajo y a los períodos de descanso que pertenecen a los trabajadores así como a las excepciones que se recogen en cuanto a su aplicación. Además, para completar el trabajo de investigación se abordará el desarrollo jurisprudencial acerca de la materia el cual resuelve las dudas que han sido planteadas por los estados miembros en cuanto a la interpretación de las disposiciones recogidas en la Directiva.

The purpose of this document is to analyze the Legal Sysitem applicable to working time through the study of Directive 2003/88 as well as its transposition to the Spanish legal system. For this, we will refer to the provisions contained in the European Directive about the maximum duration of working time and rest periods that belong to workers as well as the exceptions to their application. Furthermore, to complete the research work we will explain the jurisprudential development on the matter, which resolves the questions that have been raised by member states regarding the interpretation of the provisions set out in the Directive.
