La responsabilidad civil de los usuarios y poseedores de animales

Abstract

El hecho de tener o poseer un animal entraña un riesgo o peligro que, en la mayoría de los casos se escapa del control del propietario del animal, causando un daño a una tercera persona. En la actualidad, dicho riesgo a incrementado exponencialmente debido a que cada vez es mayor el número de animales salvajes que se tienen como si fueran animales de compañía. Este problema no sólo encuentra respuesta en nuestro Código Civil, sino que también en otras normas que el legislador se ha visto obligado aprobar con el fin de dar solución a los problemas que se han ido planteando sobre este asunto.

Having or possessing an animal involves a risk or danger that, in most cases, escapes the control of the owner of the animal, causing damage to a third person. At present, this risk has increased exponentially due to the increasing number of wild animals that are taken as if they were companion animals. This problem not only finds an answer in our Civil Code, but also in other regulations that the legislator has been forced to approve in order to solve the problems that have been raised on this matter.
