dc.description.abstractLa migración ha sido desde siempre algo inherente a la naturaleza humana. Es un hecho que ha existido y que seguirá existiendo con el paso de los siglos. Sus orígenes son de lo más variado, pero en definitiva se realizan con el único deseo de vivir en un lugar mejor. Muchas veces estas migraciones se deben a motivos económicos y voluntarios, pero otras veces no. Las hay de carácter forzado, en las que se despoja al individuo de toda voluntariedad, siendo sus causas de lo más variadas. Estas pueden tener origen en conflictos bélicos o hasta incluso en la incidencia de los desastres naturales producto del cambio climático. A todo este tipo de migraciones las denominamos “migraciones forzosas”, siendo muchas de ellas protegidas por el Derecho internacional a través de la figura del refugiado. Este trabajo de fin de máster analiza los tipos de migraciones forzosas existentes actualmente, individualizando la situación por continentes. Igualmente detalla cómo se comporta España dentro de esta coyuntura global, examinando el derecho de asilo, las peticiones para conseguir protección internacional y su procedimiento de solicitud. También analiza la evolución de la institucionalización de una de estas migraciones forzosas, en concreto de la deportación: esta migración forzosa remonta sus orígenes a la antigua Roma, en donde su primera forma la encontraríamos dentro del ámbito doméstico. Progresivamente iría evolucionando hasta que en la época imperial comenzará a ser una pena verdadera. A partir de entonces conviviría con dos nuevas formas penales, para finalmente terminar con un progresivo desuso hasta finales del siglo XIX.es_ES
dc.description.abstractMigration has always been inherent to human nature. It has been there for as long as we can remember and will be for years to come. Its origins may greatly vary, but it ultimately serves the same purpose: finding a better place to live. Many times these migrations are driven by economic motives and are voluntary, but that is not always the case. Some are migrations in which the emigrant is stripped of his own free will, and the reasons behind them can be of a very different nature: from armed conflicts to natural disasters that stem from climate change. These are what we call “forced migrations”, many of which are protected under international law through the institution of the “refugee”. This dissertation sets to analyze the different kinds of forced migrations there are, sorting them by continents. It also describes where Spain stands regarding this situation that affects the whole world, considering the right of asylum as well as the different applications for international protection and the process thereof. It also examines the evolution of the institutionalization of one specific kind of forced migration: deportation, a kind of migration that can be traced back to Ancient Rome, where it would surface in the domestic environment and would later develop into a real penalty during imperial times. Thereafter it would coexist with two new penalties only to ultimately fall into a disuse that would gradually take place until the end of the XIX century.en
