Sistematización de la jurisprudencia sobre intereses legítimos : contenido y categorías

Abstract

Este trabajo se centra en el estudio de la figura del interés legítimo ante el contenciosoadministrativo desde una perspectiva práctica, sistematizando y analizando las resoluciones dictadas por el Tribunal Constitucional y la Sala de lo ContenciosoAdministrativo del Tribunal Supremo, con el fin de identificar las características esenciales del interés legítimo que han ido perfilando estos Tribunales y por las que reconocen la legitimación activa de quien recurre. A su vez, se han identificado las diferentes categorías de intereses legítimos que permiten ser reconocido en el contencioso-administrativo como interesado en el proceso.

This work focuses on the study of the figure of legitimate interest before the contentious-administrative from a practical perspective, systematizing and analyzing the resolutions issued by the Constitutional Court and the Contentious-Administrative Chamber of the Supreme Court, in order to identify the essential characteristics of the legitimate interest that they have been shaping these Courts and for which they recognize the active legitimation of those who resort.
