El delito de tráfico de drogas

Abstract

El actual trabajo lleva a cabo un detallado análisis del tipo básico del delito de tráfico de drogas, el cual se halla en el artículo 368 del Código Penal. Se ha realizado un pormenorizado estudio doctrinal y jurisprudencial para comprender este ilícito, determinando cuáles son los actos que integran todas las conductas contenidas en dicho delito, destacando entre ellas: actos de cultivo, elaboración o tráfico, posesión, tenencia, distinguiendo en qué casos se considera que tales conductas se realizan con la finalidad de promover, favorecer o facilitar el consumo ilegal de drogas, estudiando cual es el bien jurídico protegido y las sustancias incluidas en el concepto de drogas tóxicas, así como su clasificación, diferenciando en qué supuestos existe el autoconsumo, los cuales se consideran impunes o, en su caso, están sujetos a sanción administrativa.

The present article analyses the basic type of crime of drug trafficking, typified in article 368 of the Penal Code. A detailed doctrinal and jurisprudential study has been carried out in order to understand the felony, defining which the acts that integrate the different behaviours contained are: acts of cultivation, processing or trafficking, possession, and tenure, distinguishing in which cases, such conduct, it is considered to be carried out with a view to promoting, favouring or facilitating illegal drug use, studying which is the legally protected and the substances included in the concept of toxic drugs and their classification, as well as to distinguish which assumptions of self-consumption are considered impunity or, if applicable, subject to administrative sanction.
