Evolución histórica del ministerio fiscal. Breve reseña de la institución en relación con la violencia sobre la mujer

Abstract

El trabajo tiene como objetivo analizar la evolución del Ministerio Fiscal a lo largo de la historia y reflejarlo en las numerosas disposiciones que se han ido elaborando, en función de los tipos de pensamiento y situación social de cada época. El presente análisis comienza desde el Antiguo Egipto, donde ya se mostraba en los papiros que existían algo parecido a los funcionarios cuyo fin era hacer cumplir la Ley. Se analizarán las figuras del “advocatus fisci” de la Antigua Roma, que pasará a ser parte en la Edad Media evolucionando a la figura del “patronus fiscus” y terminando esta etapa con los Reyes Católicos, los cuales instauraron la figura del Procurador Fiscal. Durante la Edad Moderna, época muy importante, pues tuvo lugar en Francia la Revolución de 1789, que, aunque su influencia tardó en reflejarse en nuestro país, el Ministerio Público se acabó viendo impregnado, donde muchos autores concuerdan en que su origen directo proviene de esa época. Quedará reflejado que las primeras funciones de esta institución fueron meramente patrimoniales (defensor del patrimonio del monarca) evolucionando hacia la imparcialidad con respecto al ámbito Ejecutivo. Culminará con el análisis detallado de la actuación del Ministerio Fiscal en nuestros días y relacionándolo con la violencia sobre la mujer. No sin antes mencionar que cada apartado concluye con una breve reflexión, incluso en ocasiones, se nombran determinadas figuras importantes para la historia y que apenas quedan reflejo de ellas por el mero hecho de ser mujeres. A raíz de la Revolución francesa y más intensamente en la Revolución industrial, comenzaron las luchas por la igualdad, corriente que no llegó a España hasta la Segunda República. A lo largo del trabajo se descubrirá las etapas por las que pasó el Ministerio Fiscal hasta lo que conocemos en la actualidad y se le relacionará con la figura de la mujer a lo largo de la historia.

The objective of this work is to analyze the evolution of the Public Prosecutor's Office throughout history and reflect it in the numerous provisions that have been prepared, according to the types of thought and social situation of each era. The present analysis begins from Ancient Egypt, where it was already shown in the papyri that there was something similar to the officials whose purpose was to enforce the Law.

The figures of the "advocatus fisci" of Ancient Rome will be analyzed, which will become part of the Middle Ages evolving to the figure of "patronus fiscus" and ending this stage with the Catholic Monarchs, who established the figure of the Fiscal Procurator.

During the Modern Age, a very important time, since the Revolution of 1789 took place in France, which, although its influence took a long time to reflect in our country, the Public Prosecutor ended up seeing impregnated, where many authors agree that its direct origin comes from that era.

It will be reflected that the first functions of this institution were merely patrimonial (defender of the patrimony of the monarch) evolving towards the impartiality with respect to the Executive scope.

It will culminate with the detailed analysis of the performance of the Public Prosecutor's Office in our days and relating it to violence against women. Not without mentioning that each section concludes with a brief reflection, even on occasions, certain important figures are named for the story and that they are hardly reflected by the mere fact of being women. Following the French Revolution and more intensely in the Industrial Revolution, struggles for equality began, a trend that did not reach Spain until the Second Republic. Throughout the work you will discover the stages through which the prosecutor went to what we know today and will relate to the figure of women throughout history.
