Los delitos de abuso sexual y agresión sexual y las consecuencias de la LO 1/2015. Análisis de un caso práctico

Abstract

En el presente trabajo nos disponemos a analizar un caso concreto, cuya defensa del acusado fue llevada a cabo por el letrado Don Arturo González Pascual en el año 2015. A Daniel se le acusaba de dos delitos de abuso sexual y un delito de abuso sexual con penetración bucal en grado de tentativa, todo ello, teniendo en cuenta que dos de las víctimas eran menores de edad. Analizaremos las pruebas aportadas por las partes, las grabaciones de cámaras de seguridad, e incluso si el acusado pudiera llegar a ser inimputable por tener trastornos psicológicos. Por último, analizaremos todo el procedimiento desde que comienza con las denuncias hasta que la Audiencia Provincial dicta sentencia, veremos si absolutoria o condenatoria.

In the present work we are going to analyze a specific case, whose defense of the defendant was carried out by Don Arturo González Pascual, lawyer, in 2015. Daniel was charged with two crimes of sexual abuse and one crime of sexual abuse with attempted oral penetration, all of this taking into account that two of the victims were minors. We will analyze the evidence provided by the parties, the recordings of the security cameras, and even if the accused could not be criminal liable because of having psychological disorders. Finally, we will analyze the entire procedure: from the first complaints until the judgement of the Provincial Court - we will see whether it is acquittal or condemnatory.
