Análisis de la sustitución en el derecho romano hereditario y en la actualidad

Abstract

El presente trabajo versa sobre el estudio de la figura de la sustitución testamentaria en el Derecho Romano y en el Derecho Civil español actual.

Este análisis tiene la finalidad de contemplar la evolución que ha tenido esta materia partiendo de la base del Derecho Romano, para en un segundo lugar dar respuesta a una figura que, aunque viene regulada en el Código Civil, tiene muchas interpretaciones. Toda la controversia que da sentido a este trabajo viene producida por la característica fundamental de este proyecto, que no es otra que la voluntad del testador.

The present work deals with the analysis of the figure of testamentary replacement in Roman Law and in the current Spanish Civil Law. This analysis has the purpose of, in the first place, to contemplate the evolution that this subject has had starting from the base of the Roman law, to later respond to a figure that although it is regulated in the Civil Code, has many interpretations. All the controversy that gives meaning to this work is produced by the fundamental characteristic of this project, which is none other than the will of the testator.
