La violencia sexual y por razón de género en el derecho penal internacional

Abstract

En este trabajo de investigación se pretende plasmar la evolución que ha tenido la violencia sexual y por razón de género en el Derecho Penal Internacional en general, y en la Corte Penal Internacional en particular. Para ello hemos estudiado cómo este tipo de violencia ha sido paulatinamente reconocida en los instrumentos internacionales de Derechos Humanos hasta la consagración de un mandato de género expreso en el Estatuto de Roma. A continuación se han identificado las formas de atribución de la responsabilidad penal y las distintas conductas típicas que permiten enjuiciar los crímenes de naturaleza sexual o por razón de género en el seno de la Corte Penal Internacional. Para concluir este estudio se ha analizado la implementación del mandato de género en los casos de la Corte que, a día de hoy, incluyen casos de violencia sexual o por razón de género.

This thesis is intended to reflect the evolution of sexual and gender based violence in International Criminal Law in general, and the International Criminal Court in particular. For this purpose we have studied how this type of violence has been gradually recognized within international Human Rights instruments until the moment an explicit gender justice mandate was enshrined in the Rome Statute. Then we have identified the different forms of criminal liability and criminal conducts that allow the prosecution of sexual and gender based crimes before the International Criminal Court. To conclude, in this thesis we have analyses the implementation of the gender justice mandate during the prosecution of cases involving sexual and gender based violence within the Court.
