Abstract
La STC 151/2017 ofrece al autor la excusa para criticar las contradicciones y lagunas de la concepción de la democracia del Tribunal Constitucional, y de paso, su uso incorrecto de las categorías centrales de la teoría general de los derechos fundamentales y en concreto del principio de proporcionalidad. Para ayudar a mejorar esa doctrina, el autor propone, ante el conflicto entre democracia representativa clásica, democracia de partidos y democracia de ciudadanos, la regla prevalente del mandato libre (art. 66.2 CE) pero admitiéndose las limitaciones que en la práctica imponen los partidos (art. 6 CE), salvo en los conflictos abiertos entre representante y partido, en cuyo caso debe atenderse a la voluntad del electorado (art. 23.1 CE), presumiéndose que este exige el cumplimiento del programa electoral; en definitiva, la democracia de ciudadanos como límite, en estos casos, tanto a la libertad de los representantes como a las órdenes de los partidos. Constitutional Court judgment 151/2017 offers the author the opportunity to criticizet he contradictions and gaps in the Constitutional Court’s conception of democracy, along with its incorrect use of the central categories of the general theory of fundamental rights and, in particular, of the principle of proportionality. To help improve the Constitutional Court’s doctrine, the author proposes, in the face of the conflict
between classical representative democracy, party democracy and citizen democracy, the prevailing rule of free mandate (article 66.2 CE), while admitting that, in practice, the political parties impose limitations (article 6 CE), with the exception of open disputes between representatives and the party, in which case the will of the electorate must be fulfilled (article 23.1 CE), under the presumption that the voters demand that the manifes to be implemented. In short, citizen democracy should act as a limit, in such cases, on
both the freedom of there presentatives and on the orders of the political parties.
