Modificación sustancial de condiciones de trabajo. Puntos críticos y aspectos procesales

Abstract

El presente trabajo tiene por finalizar realizar un análisis del régimen del art. 41 del E.T., centrándose tanto en sus aspectos ordinarios como procedimentales. Para ello se estudiará la incidencia de las sucesivas reformas laborales en la modificación sustanciales de las condiciones laborales. Por estos motivos se indagará en el concepto y clases de variaciones, así como en los supuestos que mayor transformación ha experimentado por las mutaciones legislativas y el procedimiento de impugnación de esta clase de medidas empresariales. Se prestará especial interés en los cambios de tendencia de la jurisprudencia como consecuencia de los cambios experimentados en dicho artículo, debido a que en algunos supuestos su juicio cubría aspectos que la Ley no contemplaba.

The aim of this project is to do an analysis of the regimen of substantial modification to working conditions of art. 41 of the E.T., focusing on ordinary and procedural aspects. For this, the incidence of successive labor reforms in the institution will be studied. For these reasons will be investigated in the concept and kinds of variations, as well as in the cases that have undergone the greatest transformation due to the legislative changes and the procedure of challenging this type of business measures. Special attention will be paid to the changes in the trend of jurisprudence as a consequence of the changes experienced in this article, because in some cases its judgment covered aspects that the Law did not contemplate.
