La psicopatía. Responsabilidad penal y penitenciaria

Abstract

Con el presente trabajo se pretende acercar al lector al concepto de psicopatía, especialmente a la figura del delincuente psicópata. A través de sus páginas se estudia la situación en España desde un punto de vista científico, doctrinal y especialmente jurisprudencial, analizando la evolución del concepto de psicopatía en las diferentes y dispares resoluciones del Tribunal Supremo a lo largo de los últimos años. Especial importancia tendrá en este sentido el tratamiento de la imputabilidad en este tipo de sujetos por nuestro más alto Tribunal. Por otro lado, se hará especial énfasis en todo aquello que respecta al tratamiento de la psicopatía, a la plasmación de los estudios existentes hasta la fecha en el ámbito penitenciario y a la evolución histórica que ha sufrido tanto el tratamiento en prisión como las diferentes formas de diagnóstico. Se pretende de esta forma analizar si, efectivamente, estamos dando la importancia que un problema social de esta índole se merece o, por el contrario, se sigue considerando al psicópata como algo raro propio de la industria del entretenimiento.

The intention of this work is to bring the reader to the concept of psychopathy, especially to the figure of the psychopathic criminal. Its pages examine the situation in Spain from a scientific, doctrinal and jurisprudential point of view, analyzing the evolution of the concept of psychopathy in the disparate decisions of the Supreme Court in recent years. On the other hand, special attention will be paid to everything that concerns the treatment of psychopathy, the practice of the studies that have been carried out to date in the prison environment and the historical evolution that has taken place both in prison treatment and the different forms of diagnosis. The intention is to examine whether, in fact, we are giving the importance that a social problem of this nature deserves or, on the contrary, the psychopath is still considered as something strange in the entertainment industry.
