El delito de trata de seres humanos con fines sexuales desde una perspectiva penal, criminológica y victimológica

Abstract

A través de este trabajo abordaremos el delito de tráfico de seres humanos con fines sexuales desde tres puntos de vista: penal, criminológico y victimológico. De esta manera, obtendremos una visión completa del delito tipificado en el artículo 177 bis del Código Penal. Por un lado, analizaremos el concepto normativo del delito tanto a nivel internacional como a nivel nacional. Una vez delimitado el tipo, pasaremos a centrarnos en el bien jurídico protegido, en un análisis pormenorizado del tipo básico, así como en los tipos cualificados. Tras ello, explicaremos cuáles son las fases del delito, valiéndonos de una reciente sentencia para ejemplificar cómo se organizan los tratantes a la hora de conjugar cada uno de los verbos típicos. Por último, fijaremos nuestra atención en la víctima del tráfico de seres humanos con fines sexuales, focalizándonos en sus derechos como tal, en la protección de la misma y en la relevancia de ésta en el proceso penal, en el cual podrá actuar como testigo, sin olvidar realizar un sucinto análisis del perfil del tratante.

Through this essay we will approach human trafficking for the purpose of sexual slavery froma triple perspective: criminal, criminologist and victimological, in order to get a general view from the criminal offense included in the criminal code. On one hand, we are analyzing the international and national normative-notion of human trafficking. Once the criminal definition is delimited, this essay would focus on the legal right protected, analyzing the criminal definition of the basic crime and the form of the crime that is qualified by aggravating circumstances. After that, using a recent judgment, the phases of the crime would be explained. Finally, we would focus on rights and protection of the victim of trafficking, the role of the victim in the criminal proceeding and the value of this testimony, later making a brief analysis of the common profile of the trafficker.
