Abstract
Con la aprobación de la Ley Orgánica 5/ 2000, de 12 de enero, reguladora de la Responsabilidad Penal del Menor, el legislador español dio respuesta a las exigencias que, en materia de justicia juvenil, se llevaban tiempo exigiendo de los textos internacionales, como la Convención Internacional sobre los Derechos del Niño, y del Alto Tribunal Constitucional, proclamando la preeminencia de un nuevo ordenamiento que promulgara el superior interés del menor. Sin embargo, las sucesivas reformas a las que se vio sometida fueron desfigurando su silueta inicial para algunos o dando un aspecto más punitivo, afortunadamente, para otros. En el presente estudio se abordarán la finalidad de cada una de estas reformas, el análisis de nuestro modelo de justicia penal juvenil, la comparativa con el de otros ordenamientos Europeos y Extranjeros, y finalmente, una abundante, y sobre todo, ilustrativa casuística. Estadios todos ellos, en los que intentaremos de forma crítica desmenuzar nuestra todavía novedosa Ley Orgánica de Responsabilidad Penal del Menor. With the enactment of the Organic Law number 5/2000, of January 12th, of Criminal Responsibility of Minors, Spanish government give the answer to all of juvenile justice demands which ones, for a long time, comes from the international orders, such as the Convention on the Rights of the Child, or the Spanish Constitutional Court, who proclaimed the prevalence of a new justice order that promulgates the superior interest of childs. However, the successive reforms which ones this new Organic Law suffered were disfiguring its initial justice silhouette for the detractors, or giving a necessary punitive aspects, fortunately, for others. In this study, we’ll deepen in all of these reforms, we’ll analyze our juvenile criminal justice system, we’ll compare each order with others European and foreign systems too, and finally, an abundant and illustrative casuistry. All of these stages with which ones we’ll try to make a review to unravel our still new Organic Law of Criminal Responsibility of the Minor.
