Matrimonio, divorcio y filiación. Comparativa entre los distintos regímenes aplicables (Derecho romano y Derecho actual español)

Abstract

El estudio de los documentos jurídicos conservados respecto al derecho romano, nos hace conocedores de la evolución que ha sufrido la legislación actual. En este trabajo se muestra la evolución dentro del derecho civil (matrimonio y familia) y como, a lo largo de los tiempos, este derecho se ha ido amoldando a las necesidades de la sociedad cambiante. El análisis de la documentación de la época clásica nos enseña cómo la mujer romana carecía de reconocimiento en la sociedad. Esta falta de reconocimientos jurisdiccionales, conllevó a que el varón fuera una gran autoridad en la época romana, siendo capacitado para ejercer su potestad reconocida en la legislación posterior. No obstante, el pueblo romano fue evolucionando y con ello las fuentes jurisprudenciales, aconteciendo un profundo desarrollo, siendo Justiniano el pilar fundamental, y continuando con su desarrollo, Alfonso X con las VII Partidas. Progreso que aun se prolonga.

Analysis of well-conserved legal documents concerning Roman law which allow us to be aware of the evolution that happened in current regulations. In this work, evolution has been carried out within civil law and marriage, over time, this right has been adapted to the needs of the changing society. The analysis of the documentation of the classic time teaches us how the Roman woman, recognition attention in society. This lack of jurisdictional recognitions, i carry to the man was a great authority in Roman age, being able to exercise their recognized practice in subsequent legislation.
