El derecho de los menores a acceder a su historia clínica

Abstract

El objetivo de este trabajo de fin de máster es analizar si los menores pueden acceder a su historia clínica y, en caso afirmativo, en qué condiciones y cuáles son las consecuencias del ejercicio o limitación de este acceso. Todas estas cuestiones surgen a raíz de una consulta planteada a la Clínica Legal de la Universidad de Alcalá. Por ello, es necesario realizar un recorrido por las distintas disposiciones normativas que se refieren a los derechos de los menores y, en concreto, a aquellos relacionados con sus derechos como pacientes.

The goal of this dissertation is to study if the minors can access to their clinical history and, if so, under what conditions and what are the consequences of the exercise or limitation of this access. All these questions arise from a query submitted to the Legal Clinic of the Universidad de Alcalá. For this reason, it is necessary to take a tour though the different normative provisions that refer to the minor’s rights and, in particular, those related to their rights as patients.
